Qishaash law in Al Baqarah 178 and 179
Al Baqarah 178
O you who have believed, prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment.
Al Baqarah 179
And there is for you in legal retribution [saving of] life, O you [people] of understanding, that you may become righteous.
Al Baqarah 194 :
[Fighting in] the sacred month is for [aggression committed in] the sacred month, and for [all] violations is legal retribution. So whoever has assaulted you, then assault him in the same way that he has assaulted you. And fear Allah and know that Allah is with those who fear Him.
Al Maa'idah 32
Because of that, We decreed upon the Children of Israel that whoever kills a soul unless for a soul or for corruption [done] in the land - it is as if he had slain mankind entirely. And whoever saves one - it is as if he had saved mankind entirely. And our messengers had certainly come to them with clear proofs. Then indeed many of them, [even] after that, throughout the land, were transgressors.
Qishaash is the basis of the Book (Torah)
Qur'an in which we include as above (Al-Baqarah 178-179; Al Baqarah 194; Al Maa'idah 32) is certainly not exhaustive and does not clearly exist. Actually, if we compare with the Bible Qur'an in the above is the adaptation / taken from the Book. Scripture is very clear in the background of the Qishaash law. Very different from the explanation of the Qur'an which is only a piece of a piece. Qishaash legal basis is Exodus 21: 12-36; Leviticus 24: 17-23 and Deuteronomy 19: 1-21. By reading these verses will be very clear and explicit. So that all know and understand about these verses Qishaash then we include at the end of this post. In the Bible explained that Qishaash derived directly by God to Moses that are binding for the people of Israel and later in Leviticus and Deuteronomy are also applicable to other than the Israelites who lived in the middle of Israel. Qishaash law of God conveyed to Moses for the people of Israel because his neck was so stiff the people of Israel at that time. So need strict rules and regulations clearly
In Exodus 21: 12-36 Indonesian Bible Society (LAI) provides Title Insurance Regulations life of man. While in Leviticus 24: 17-23 KJV God's name gives the title Scourge of others convicted crime. Whereas in Deuteronomy 19: 1-21, there are 3 titles each passage with city city of refuge - prohibition encroach on land and from the witness it.
In Exodus - Leviticus and Deuteronomy as above loaded very clear information about Qishaash. Very different from the information contained in the Qur'an. Therefore, when Muslims refer only to the Qur'an or hadith only, we believe that complete and correct information can not be obtained. God's Word in the Bible about such Qishaash actually been enhanced by the love of Jesus Christ with the law. But by the Qur'an that comes later returned to the law with impunity love given by Jesus Christ.
Qishaash law has been refined in the law of love
Actually before God delivered to Moses Qishaash law in the Book of Exodus, Leviticus and Deuteronomy as described above, the law of love of God also gives as written in Genesis 23: 4-5 as below:
I am a stranger and a sojourner with you: give me a possession of a buryingplace with you, that I may bury my dead out of my sight. And the children of Heth answered Abraham, saying unto him,
Verse events 23: 4-5 is very clear on God's command to love our neighbor, even to your enemies, so you also should love including the animals and plants grown enemies. The above verse teaches how humans should love one another, not to retaliate in kind with his actions.
If we observe further between the revelation of love law as written in Genesis 23: 4-5 first derived from Qishaash law. What does it mean? God initially apply the law of love that man (People of Israel) mutually love one another, but because of the arrogance of the God of Israel be lowered Qishaash tougher laws.
Leviticus 19:18 Thou shalt not avenge, nor bear any grudge against the children of thy people, but thou shalt love thy neighbour as thyself: I am the LORD.
Hebrew verse 19 to verse 18 above with God firmly convey that humans do not take revenge and do not hold a grudge against someone else, but God recommends that each man love his neighbor. Vengeance is wholly owned by God. Hebrews 10:30 "For we know Him who said," Vengeance is mine. I will repay. "And again:" The Lord will judge his people. "
But because of the hardness of the hearts of the children of Israel went down Qishaash verses as in Exodus 21: 12-36; Leviticus 24: 17-23 and Deuteronomy 19: 1-21.
The Bible is the New Testament says Jesus Christ many times and perfected and reiterated by restoring law Qishaash become the law of love. Some of God's word that completes Qishaash law with the law of love as shown below.
Matthew 5 : 43 - 48
5:43 Ye have heard that it hath been said, Thou shalt love thy neighbour, and hate thine enemy.
5:44 But I say unto you, Love your enemies, bless them that curse you, do good to them that hate you, and pray for them which despitefully use you, and persecute you;
5:45 That ye may be the children of your Father which is in heaven: for he maketh his sun to rise on the evil and on the good, and sendeth rain on the just and on the unjust.
5:46 For if ye love them which love you, what reward have ye? do not even the publicans the same?
5:47 And if ye salute your brethren only, what do ye more than others? do not even the publicans so?
5:48 Be ye therefore perfect, even as your Father which is in heaven is perfect.
Matthew 22 : 37-40
22:37 Jesus said unto him, Thou shalt love the Lord thy God with all thy heart, and with all thy soul, and with all thy mind.
22:38 This is the first and great commandment.
22:39 And the second is like unto it, Thou shalt love thy neighbour as thyself.
22:40 On these two commandments hang all the law and the prophets.
Matthew 19 : 18-19
19:18 He saith unto him, Which? Jesus said, Thou shalt do no murder, Thou shalt not commit adultery, Thou shalt not steal, Thou shalt not bear false witness,
19:19 Honour thy father and thy mother: and, Thou shalt love thy neighbour as thyself.
Luke 6 : 27-36
6:27 But I say unto you which hear, Love your enemies, do good to them which hate you,
6:28 Bless them that curse you, and pray for them which despitefully use you.
6:29 And unto him that smiteth thee on the one cheek offer also the other; and him that taketh away thy cloak forbid not to take thy coat also.
6:30 Give to every man that asketh of thee; and of him that taketh away thy goods ask them not again.
6:31 And as ye would that men should do to you, do ye also to them likewise.
6:32 For if ye love them which love you, what thank have ye? for sinners also love those that love them.
6:33 And if ye do good to them which do good to you, what thank have ye? for sinners also do even the same.
6:34 And if ye lend to them of whom ye hope to receive, what thank have ye? for sinners also lend to sinners, to receive as much again.
6:35 But love ye your enemies, and do good, and lend, hoping for nothing again; and your reward shall be great, and ye shall be the children of the Highest: for he is kind unto the unthankful and to the evil.
6:36 Be ye therefore merciful, as your Father also is merciful.
The Bible does explain a lot about the law Qishaash and also the Law of Love. Which do you think is better to follow God's command before or obey God's commandments that have been perfected. For it is written that the word of God lasts forever. In other words if you still retain the old rules when the latest regulations also been endorsed by God Himself. When the latter are present Qur'an from the Torah and the Gospel and then apply the old rules when the latest regulations already exist then it deserves to be questioned because the Qur'an itself has admitted the truth of the Book of Allah. Qishaash law actually just giving them the opportunity and freedom for the rich and affluent could atone for the sins of his property. As for people who can not afford the death penalty is chosen because there is no ability to make amends with his property. If the law is implemented, which facilitated Qishaash is the person who has a lot of treasures. So that the man could be atoned for his property his sins. This situation is also similar to the pilgrimage. Only those who can afford the required pilgrimage, Hajj is the same with God's forgiveness to buy property. Law applies here buying and selling. Your sins are forgiven afford it, if you are not able to simply choose Hell as a place to live. This is what Muhammad thought as outlined in the Qur'an.
Actually, human life on earth is not just using her because life only once, but how to make life in the world is the only one to make the world a better and more meaningful. As written in Galatians 5: 13
For, brethren, ye have been called unto liberty; only use not liberty for an occasion to the flesh, but by love serve one another.
Leviticus 24: 17-23
24:17 And he that killeth any man shall surely be put to death.
24:18 And he that killeth a beast shall make it good; beast for beast.
24:19 And if a man cause a blemish in his neighbour; as he hath done, so shall it be done to him;
24:20 Breach for breach, eye for eye, tooth for tooth: as he hath caused a blemish in a man, so shall it be done to him again.
24:21 And he that killeth a beast, he shall restore it: and he that killeth a man, he shall be put to death.
24:22 Ye shall have one manner of law, as well for the stranger, as for one of your own country: for I am the LORD your God.
24:23 And Moses spake to the children of Israel, that they should bring forth him that had cursed out of the camp, and stone him with stones. And the children of Israel did as the LORD commanded Moses.
